1. Identification details of the owner

In compliance with Article 10 of Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI), we inform you that the websites www.biospheretourism.com and www.biospheresustainable.com (hereinafter, the "websites") are owned by:

2. Purpose and acceptance

The purpose of the websites is to provide BRT's clients and the general public with information on the services offered by BRT, the entities holding certifications issued by BRT, news of interest and other content related to its activity.

Access to the websites and their use confer the status of user and imply acceptance of this Legal Notice. The contracting of services through the websites is furthermore governed by our Terms and Conditions, and the certification services by their own contractual documentation.

BRT may modify the information contained on the websites, its configuration and its presentation at any time, as well as temporarily suspend access for technical, maintenance or security reasons. The version of this Legal Notice in force shall be the one published on the websites at any given time.

 

3. Conditions of use

The user undertakes to use the websites and their content in accordance with the law, this Legal Notice, good faith and public order. In particular, the user undertakes not to use them for unlawful purposes or purposes that infringe the rights of BRT or third parties, not to introduce viruses or any other harmful code, and not to attempt to access without authorisation restricted areas, systems or databases belonging to BRT.

 

4. Intellectual and industrial property

BRT is the owner of, or holds the corresponding licence for, the intellectual and industrial property rights over the websites and their content (texts, images, design, source code, logos, trademarks and other elements).

The Biosphere brand, its logos, seals and distinctive marks, as well as the Biosphere Scheme and its visual identity, are the property of the Institute for Responsible Tourism (ITR). Their use by certified entities is governed by the Regulation on the use of the Biosphere brand and distinctive marks. As an accredited certification body, BRT uses the Biosphere brand in accordance with the conditions established by the ITR to identify certifications granted under the Biosphere Scheme.

The reproduction, distribution, public communication or transformation, in whole or in part, of the content of the websites without the prior written authorisation of the rights holder is prohibited, except to the extent necessary for consultation or printing for personal, non-commercial purposes.

 

5. Third-party trademarks

The trademarks, trade names or logos of third parties appearing on the websites belong to their respective owners and are recognised as such. Their appearance is for informational purposes and does not necessarily imply a recommendation of the corresponding products or services. Such owners may request the modification or removal of information concerning them by writing to info@biospheresustainable.com.

 

6. Links

The websites may include links to third-party pages. BRT does not control and is not responsible for their content, unless it has actual knowledge of their unlawfulness and fails to act diligently to remove or disable the link, in accordance with Article 17 of the LSSI. The conditions for linking to our websites are set out in Section 8 of our Terms and Conditions.

 

7. Liability

BRT strives to ensure that the information on the websites is correct and up to date, but does not guarantee the absence of errors or the uninterrupted availability of the websites. To the extent permitted by law, BRT shall not be liable for damages arising from the use of information published in general, from service interruptions beyond its control, or from the presence of viruses or other harmful elements that could not be detected despite having adopted reasonable security measures.

This limitation does not affect liability that cannot legally be excluded, nor the rights that consumer and user legislation recognises for users.

 

8. Data protection, cookies and confidentiality

BRT processes users' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 (GDPR), and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights. Information obtained or generated during certification processes is processed in accordance with our Confidentiality Policy.

 

9. Comments and suggestions

Any comments, suggestions or ideas voluntarily sent to us through the websites' general contact channels may be used by BRT to improve its services, without giving rise to any form of compensation. This does not apply, under any circumstances, to information or documentation provided by entities within the framework of their certification processes.

 

10. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For any dispute relating to the websites, the provisions set out in Sections 18 and 19 of our Terms and Conditions shall apply. If you are a consumer, you may in any case bring proceedings before the courts of your place of domicile.
